Terms of Use

These Terms of Use ("Terms") govern your access to and use of VoltCRM, a customer-relationship management and AI-assisted messaging platform provided by AppNerds ("VoltCRM", "we", "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The service

VoltCRM provides tools to manage contacts, enrollments, appointments, and to send and receive messages across channels such as SMS, WhatsApp, web chat, email, and voice, including AI-assisted responses. We may update, add, or remove features over time.

2. Your account

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 and authorized to bind the business you represent.

3. Acceptable use

• Use the service only for lawful business purposes and in compliance with all applicable laws.
• Do not send spam, harassing, deceptive, or unlawful content, or infringe others' rights.
• Do not attempt to disrupt, reverse-engineer, or gain unauthorized access to the service.

4. Messaging compliance (important)

You are solely responsible for obtaining and maintaining the consent required to contact your recipients and for complying with all applicable rules — including the TCPA, CAN-SPAM, carrier and A2P/10DLC requirements for SMS, and the WhatsApp Business Platform and Meta policies. You must honor opt-out requests (e.g., STOP) and provide required disclosures. You agree to indemnify us for claims arising from your messaging or content.

5. Fees & billing

Paid plans and usage-based charges (including messaging costs passed through from providers) are billed as described at signup. Fees are non-refundable except as required by law. We may change pricing with notice.

6. Third-party services

The service integrates third-party providers (such as Telnyx, Meta/WhatsApp, Supabase, Anthropic, and Stripe). Your use of connected services may be subject to their own terms, and we are not responsible for third-party services.

7. Intellectual property

VoltCRM and its software, design, and trademarks are owned by AppNerds and its licensors. You retain ownership of the data you submit; you grant us the rights needed to operate and improve the service and to process your data as described in our Privacy Policy.

8. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated content may be inaccurate; you are responsible for reviewing messages sent on your behalf.

9. Limitation of liability

To the maximum extent permitted by law, AppNerds will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the amounts you paid to us in the 12 months before the claim.

10. Termination

You may stop using the service at any time. We may suspend or terminate access for violation of these Terms or to protect the service. Upon termination, your right to use the service ends; certain provisions survive by their nature.

11. Governing law & changes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. We may update these Terms; material changes will be indicated by updating the "Last updated" date above.
